Welcome to As Seen Fit (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the As Seen Fit mobile application and any related services (collectively, the “Service”). By using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
4. User Content
The Service allows you to upload photos, outfits, and other content (“User Content”). You retain ownership of your User Content. By uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, use, display, and process your User Content for the purpose of operating and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to the User Content you upload.
- Your User Content does not violate any third-party rights or applicable law.
- You will not upload content that is unlawful, offensive, or harmful.
5. AI-Generated Content
The Service uses artificial intelligence (including Google’s Gemini models) to generate virtual try-on images, sizing recommendations, styling suggestions, and outfit captions. AI output may not always be accurate, realistic, or suitable for purchase decisions. Sizing recommendations are estimates based on photos and the measurements you provide and may differ from actual fit. AI output is provided “as is” without warranty. You are responsible for how you use any AI-generated content.
6. Subscriptions & Payments
The Service offers a free tier with a limited number of AI generations and paid subscription tiers (Monthly Pro and Yearly Pro) that increase your generation limits and unlock additional features.
Subscriptions are billed through the Apple App Store or Google Play Store and are subject to the applicable store’s terms. Payment will be charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
You may manage and cancel your subscription at any time through your Apple ID or Google account settings. No refund will be provided for the unused portion of the current billing period.
7. Prohibited Conduct
You agree not to:
- Reverse engineer, decompile, or tamper with the Service.
- Upload malicious code or attempt to disrupt the Service.
- Use the Service for any unlawful purpose.
- Upload photos of other people without their explicit consent. The virtual try-on feature is intended for use with photos of yourself or with the documented consent of the person depicted.
- Upload nude, sexually explicit, hateful, violent, or otherwise harmful content.
- Misrepresent or attempt to circumvent subscription limits, payment systems, or content moderation.
8. Intellectual Property
The Service and all related trademarks, logos, and content (excluding User Content) are owned by As Seen Fit, Inc. or its licensors. You may not copy, modify, or distribute any portion of the Service without our prior written consent.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms. You may stop using the Service at any time.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, As Seen Fit, Inc. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
